The Scottish Human Rights Commission has submitted two reports to the United Nations Committee for the Convention on the Rights of Persons with Disabilities (CRPD). The reports have been prepared jointly by the Commission and the other members of the UK and Scottish Independent Monitoring Mechanisms for the CRPD.
The reports set out a series of areas where disabled people's rights are not currently being fully protected and realised in Scotland. They have been submitted to the UN Committee
The Commission welcomes the Scottish Parliament Justice Committee's Stage 1 Report on the Scottish Biometrics Commissioner Bill which concludes that a new Biometrics Commissioner should have stronger enforcement powers.
In particular, we are pleased to see evidence given by Judith Robertson, Chair of the Commission, reflected in the Commission's conclusions that the Code of Practice must be placed on a statutory footing.

The Commission welcomes the Mental Welfare Commission’s report into discharges of adults with incapacity from hospitals to care homes during the pandemic. The report shines a light on practices which may amount to a deprivation of liberty under the European Convention on Human Rights. Importantly, the report makes several recommendations to Health and Social Care Partnerships, the Care Inspectorate and the Scottish Government, to ensure that the rights of people in situations of vulnerability
Human Rights concerns about the ‘Tinker Experiment’ were also raised by the advisory committee on the Framework Convention for the Protection of National Minorities in 2022, who said: “The Advisory Committee considers that truth and reconciliation processes in the context of past assimilation can contribute to building mutual trust in the long run.”
