Scottish Human Rights Commission intervenes in judicial review brought by For Women Scotland against Scottish Ministers on the Management of Transgender People in Custody
The Scottish Human Rights Commission (SHRC) has provided a written and oral intervention to assist the Court in the judicial review brought by For Women Scotland against the Scottish Ministers. The case will determine the legality of the Scottish Prison Service policy for the management of transgender people in custody operational guidance.
To assist the Court, the SHRC's legal intervention highlights the human rights of all people relevant to the court's consideration of the issues raised in the petition, in line with its mandate as the independent National Human Rights Institution for Scotland.
The Scottish Human Rights Commission’s intervention is not to support or oppose either party. The SHRC will not provide any further comment until the judgment is delivered by Lady Ross.
